107. No Smoking

Section 1. Purpose

The Marshall Lyon County Library is dedicated to providing a welcoming and safe environment. The Library Board expands upon the Minnesota Clean Indoor Air Act by prohibiting smoking on any Library property.

Section 2. General Regulation

The use of any tobacco product is prohibited on Library property, both inside and outside the Library building.
Customers or staff are permitted to use tobacco products inside private vehicles while parked on Library property. However, any waste resulting from using tobacco products must be disposed of within the vehicle and not on the Library’s property, such as the parking lot.

Section 3. Definitions

Smoking: Inhaling, exhaling, burning or carrying any lighted or heated cigar, cigarette, pipe or any other lighted or heated product containing, made or derived from nicotine, tobacco, marijuana, or other plant intended for inhalation, including carrying or using an activated electronic delivery device.

Tobacco products: All forms of tobacco including, but not limited to, cigarettes, cigars, pipes, chewing tobacco, water pipes, electronic cigarettes and smokeless tobacco products.

Library property: Buildings and structures, grounds, parking lots, sidewalks and Library-owned vehicles.

Section 4. Penalties

Anyone found smoking or otherwise using tobacco products on Library property will be asked to cease immediately and given a warning. If the person refuses to comply or is caught a second time, they will be asked to leave the Library property. After being given a warning, anyone who continues to break this policy may be temporarily banned from the property, depending on the egregiousness of the non-compliance.

The Library Director or designee makes all enforcement and penalty decisions.
